1. Agreement to Terms

By accessing and using the ReachPulse Media website (reachpulsemedia.com) and engaging our services, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you should not use our website or services.

2. Services

ReachPulse Media (ABN 72 641 389 507) provides social media marketing, digital strategy, content creation, performance marketing, and related digital media services. The specific scope, deliverables, and terms of any engagement will be outlined in a separate service agreement or proposal provided to the client.

3. Client Obligations

When engaging our services, clients agree to:

• Provide accurate and complete information necessary for the delivery of services
• Grant necessary access to social media accounts, analytics platforms, and other relevant tools
• Review and provide timely feedback on deliverables and content
• Ensure that all materials provided to us do not infringe on third-party rights
• Pay invoices within the agreed payment terms

4. Payment Terms

All fees are quoted in Australian Dollars (AUD) and are exclusive of GST unless stated otherwise. Payment terms are outlined in the service agreement. Late payments may incur additional charges as specified in the agreement. Advertising spend budgets are billed separately at cost.

5. Intellectual Property

Unless otherwise agreed in writing, all creative works, content, and materials produced by ReachPulse Media remain our intellectual property until full payment has been received. Upon full payment, ownership of client-specific deliverables transfers to the client. We retain the right to use completed work in our portfolio and marketing materials unless otherwise agreed.

6. Confidentiality

Both parties agree to maintain the confidentiality of proprietary information shared during the engagement. This includes business strategies, financial information, customer data, and any other information designated as confidential.

7. Limitation of Liability

To the maximum extent permitted by law, ReachPulse Media shall not be liable for any indirect, incidental, consequential, or punitive damages arising from the use of our website or services. Our total liability for any claim shall not exceed the fees paid by the client for the specific services giving rise to the claim.

8. Termination

Either party may terminate a service engagement by providing written notice in accordance with the terms specified in the service agreement. Upon termination, the client is responsible for payment of all services rendered and expenses incurred up to the date of termination.

9. Website Use

You may use our website for lawful purposes only. You must not:

• Use the website in any way that breaches applicable laws or regulations
• Attempt to gain unauthorised access to any part of the website or its systems
• Reproduce, distribute, or modify any content from the website without written permission

10. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of Western Australia, Australia. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Western Australia.

11. Changes to Terms

We reserve the right to update these Terms of Service at any time. Changes will be posted on this page with an updated revision date. Continued use of our website or services following any changes constitutes acceptance of the revised terms.
